In 2014, comedian and actor Tracy Morgan was involved in a devastating highway crash that left him critically injured and took the life of his friend and fellow comedian, James "Jimmy Mack" McNair. The accident occurred on the New Jersey Turnpike when a Walmart tractor-trailer, driven by a fatigued driver, slammed into Morgan’s limo van. What Happened? On June 7, 2014, Morgan and several passengers were returning from a comedy performance in Delaware when their vehicle was struck from behind by a Walmart truck. The truck driver, Kevin Roper, had allegedly been awake for over 28 hours before the crash and was driving over the speed limit at the time of impact. The crash resulted in severe injuries for Tracy Morgan, including a traumatic brain injury, broken ribs, a broken leg, and a broken nose. Tragically, Jimmy Mack was killed on impact. The Lawsuit Against Walmart. Morgan and the other survivors filed a personal injury lawsuit against Walmart, arguing: 1) Negligence – Walmart failed to ensure their driver was well-rested and fit to drive. 2) Violation of Trucking Safety Laws – The driver had exceeded federal trucking regulations limiting work hours to prevent fatigue-related crashes. 3) Wrongful Death – The lawsuit also sought justice for Jimmy Mack’s family. The Settlement & Aftermath. Walmart settled the lawsuit in 2015 for an undisclosed amount, but reports estimated it to be $90 million or more. Tracy Morgan underwent extensive rehabilitation and had to learn to walk again. Walmart enhanced its trucking policies, emphasizing driver rest and compliance with federal regulations. The case raised awareness about trucking industry safety, leading to stricter enforcement of fatigue-related driving laws. Why This Case Matters. It highlighted the dangers of driver fatigue in the trucking industry. It pressured large corporations to take greater responsibility for their employees' actions. It set a precedent for holding companies accountable when their policies lead to accidents. Tracy Morgan’s Comeback: After nearly two years of recovery, Morgan returned to comedy with a powerful SNL monologue in 2015. He later starred in his own show, "The Last O.G.," proving his resilience and determination.
