Trivedi & Khan, P.C. has a distinguished history of pro bono work and a strong commitment to giving back to the community. One recent pro bono case involved a prisoner at a Cook County correctional facility who suffered a permanent injury due to inadequate medical attention while incarcerated. The injury was documented in prison medical records, however despite this, police officers, healthcare workers, and correctional officers failed to provide the necessary aid, resulting in both severe physical harm and emotional harm to the prisoner. After years of litigation, the case was successfully settled with the Cook County Sheriff. The claims were brought under the Civil Rights Act of 1871 and the 8th Amendment (cruel and unusual punishment) of the Constitution. The 1983 act, a part of the Civil Rights Act of 1871, allows for monetary and injunctive relief against individuals authorized under federal or state law who violate constitutional rights. Zubair Khan of Trivedi & Khan proudly attended the annual National Association of Muslim Lawyers (NAML) conference in Chicago, IL. Mr. Khan moderated a panel featuring Professor Faisal Kutty, Shehla Syed, Heena Musabji, and Mazen Basrawi.?The panel discussed ways to navigate a legal career and maintain a healthy work-life balance. During the session, panelists shared their personal and professional experiences, highlighting the diverse journeys within the legal field and emphasizing the importance of identity, professional development, mental health, and an open mind. For the past 25 years, NAML has served as a vital platform for networking, collaboration, and fostering a sense of community among legal professionals across the nation. This year’s conference, themed “A Milestone of Unity” celebrated 25 years of legal excellence within the association. Trivedi & Khan, P.C. successfully represented an auto company in a trademark lawsuit filed by a large automobile dealership. After four years of litigation, the Court recently granted Summary Judgment in favor of T&K’s client in 2023. The lawsuit, initiated by Plaintiff in the District Court for the Northern District of Illinois, alleged that T&K’s client misused Plaintiff’s trademark rights by using a similarly sounding name. Plaintiff brought claims under the Lanham Act, the Illinois Uniform Deceptive Trade Practices Act, the Illinois Consumer Fraud and Deceptive Trade Practices Act, and Illinois Common Law. T&K filed for Summary Judgment on all four claims, and the Court dismissed all claims. To bring a little background, Plaintiff registered the mark in 2019 while Defendant established his auto company in 2010. Mr. Zubair Khan, representing Defendant, argued that Plaintiff did not have a protectable interest because they did not actively use the name, and the name was merely descriptive with no secondary meaning. The Plaintiff primarily used a different name for their dealership and only referenced the mark in its websites after the lawsuit was filed. The Court agreed with Mr. Khan's arguments, citing cases such as Johnny Blastoff, Inc. v. Los Angeles Rams Football Co., 188 F.3d 427, 433 (7th Cir. 1999), and Uncommon, LLC v. Spigen, Inc., 926 F.3d 409, 422 (7th Cir. 2019). It concluded that the Plaintiff's use of the name was not continuous and that the name lacked secondary meaning, being used primarily in a geographical sense. Across many counties throughout Illinois, Mr. Zubair Khan and the litigation team at Trivedi & Khan were able to protect parties from outrageous monetary demands in negligence cases. Often times, these cases result in successful jury results. Some recent notable cases from 2024 include: - In January of 2024, Mr. Khan defended his client after plaintiff sought over $12 million in damages due to a motor vehicle accident. Following a five-day jury trial in Dekalb County, IL the jury reached a verdict of $20,000, less than 2% of the demand. Through the litigation team’s extensive trial expertise and effective cross-examination, Mr. Khan was able to substantially reduce the exposure for his client. - In February of 2024, a DuPage County jury reached a verdict of $75,000 after plaintiff sought $1 million in damages from a motor vehicle accident. Using clearly presented facts and evidence, along with multiple expert witnesses, the jury awarded less than 8% of the demand. - Following a four-day trial in DuPage County, IL, the jury reached a verdict of $49,254 in monetary damages after plaintiff sought over $450,000. Using credible witnesses and evidence, Mr. Khan was able to convince the jury that the outrageous demand was not warranted.
