TorresVictor obtained summary judgment in favor of our surplus lines insurer clients in a Palm Beach County roofing AOB suit. The roofer claimed that the condominium association's 36 roofs all needed to be replaced due to Hurricane Irma damage at a cost in excess of $13 million. Judge Goodman ruled that the insured did not comply with its duty to provide prompt notice of the loss and that the plaintiff roofer did not meet its burden to rebut the presumption of prejudice that attaches under Florida law when the insured does not comply with the policy's prompt notice provision.
