Another NEC lawsuit begins this week in St. Louis, Missouri state court against formula companies Reckitt and Abbott. With two major NEC verdicts already coming down against these companies this year, we will be closely watching the fight for justice for premature babies put at risk by formula manufacturers. Tor Hoerman, our attorney who represented the plaintiff who was awarded the $495 million verdict against Abbott, said that manufacturers are pushing a "message of fear" to doctors. "Nobody is requesting that the product be pulled from the market," Hoerman said. Instead, the manufacturers "could put a simple warning about risk" on the formulas' labels.
