Breaking News: SLF partner Mike Lutz successfully defends $8 million jury verdict on appeal to the 10th Circuit! The wrongful death case stemmed from denial of adequate medical care at the Davis County, Utah Jail. While detained at the Jail, Heather Miller fell from a top bunk and suffered a ruptured spleen. After only a cursory examination that did not even include taking vital signs, a jail nurse placed Heather alone in a cell — where she lay in agony as she slowly bled to death over the course of hours. Tad Draper and Dan Baczynski tried the case to a jury. The trial team reached out for our firm’s help in defending their case on appeal. Draper said, “Dan and I decided that we needed a separate voice and someone particularly skilled in appellate work.” Spence partner Mike Lutz handled the appeal. Lutz commented “Tad and Dan put on a masterful trial. When they entrusted their verdict to me to defend on appeal, it was one of the greatest honors of my career. Their passion and commitment inspired me to dig deep and fight hard during the last battle of this epic, multi-year case.” The case is Stella & Estate of Miller v Davis County et al., No. 23-4122 (D.C. No. 1:18-CV-00002-JNP)(D. Utah) Well done team!

Out there walking the walk… Mel is just back from the latest Trial School Symposium where he taught about mastering Opening Statements. Thanks for sharing and leading by example Mel Orchard! Lawyers from around the country got to see Mel in action. He gave a demonstration on opening statement, as did several of the best trial lawyers in America, including Jim Perdue Jr., Mike Kelly, Doris Cheng, Kathleen Nastri and John Uustal. The group worked on openings on their feet for a half day with instruction from the Trial School faculty. The following day they worked on negotiation strategies and learned from three of the best in the business in Doris Cheng, Ben Rubinowitz and Andrew Finkelstein. The final day Mel did another Opening Statement demonstration on a different case going to trial soon, as did Jim Purdue and Kathleen Nastri. Keep leading by example, Mel — thank you for giving back!

Lots happening around here! We don’t have the whole crew together all that often— SLF partners in one of our Jackson conference rooms prepping for trials coming up in November, December and January, plus planning for Firm retreat and talking about new additions to the team. Exciting time for our team in 2024!
