I will be presenting an hour-long discussion on arbitration in family law disputes to the Oklahoma Bar Association Family Law Division on Wednesday, October 16 at noon CST. The Scottish Arbitration Festival began last evening with an interesting discussion with Lady Hale, a former Justice of UK Supreme Court. As an American lawyer, I was pleasantly surprised and envious such appointments to the highest court in Great Britain are apolitical. We Americans are very proud of our constitutional republic, as we should be, but there are times we should look at our sibling democracies and learn what they may do better or where ours is falling short. The politicalization of our courts would be a good place to start. Lady Hale indulged me in a photograph. She began her legal career in the family courts before becoming a judge. The discussion delved into the use of arbitration in family law disputes which is a relatively new concept in Britain and what the Oklahoma Arbitration Center will be offering. In both systems the award has to be approved and sanctioned by the Court. She explained that approval should look more like a “rubber stamp” than a judicial review of the award. This makes the process somewhat unique for arbitrations.
