We often hear of legal professionals being “risk averse.” This sentiment especially applies when it comes to AI adoption. But in most cases, this aversion is simply a method to avoid costly mistakes. Thankfully, we heard from four experts during Relativity’s Dallas session, who gave us actionable steps for how to ensure you're using AI in a defensible and accurate way. Their Key Takeaways: 1?? Importance of Validation: Statistical validation (recall, precision, elusion) remains essential in assessing AI-based document review, similar to traditional TAR (Technology Assisted Review). Qualitative validation becomes crucial with generative AI. Reviewers need confidence that AI-generated rationales or predictions accurately reflect document relevance. 2?? Communication and Transparency with Regulators: Proactive engagement with regulators (e.g., SEC) early in the discovery process builds trust. Clearly explaining AI processes, providing statistical measures, and being prepared to answer questions helps regulators confirm production compliance. Regulators may request insights into prompts or methodologies used, though disputes about the privilege of such information are anticipated. 3?? Balancing Recall and Precision: Achieving high recall (identifying all relevant documents) must be balanced against precision (avoiding excessive irrelevant documents). Unlike traditional predictive coding, generative AI does not offer a simple "cut-off" threshold to tune recall and precision. Instead, prompt refinement is the primary lever to improve accuracy. 4?? Defensibility and Documentation: Regardless of the technology used, the process must be clearly documented and defensible, especially in litigation contexts. Lawyers must demonstrate a "reasonable inquiry" into responsiveness, aligning with Rule 26(g) certification requirements. 5?? Risks and Limitations: Over-reliance on metrics like "accuracy" can be misleading due to data imbalances. Transparency about rationale and process with opposing parties can expose litigants to unnecessary "circumstantial" challenges, particularly from aggressive opposing counsel. 6?? Broader Application of Generative AI: Generative AI should not only be viewed as a direct replacement for document review but as a transformative tool impacting broader legal strategy, case narratives, and investigations. Early familiarity and confidence-building with generative AI tools enhance adoption among legal teams. 7?? Regulatory Perspective: Regulators see significant efficiency benefits if generative AI is used properly, as it reduces irrelevant document production and expedites investigations. Regulators are actively working to better understand generative AI and encourage candid dialogue to facilitate mutual trust and efficiency.
