📣 ACCESS TO JUSTICE IN LEGAL MALPRACTICE CASES PRESERVED! We were honored to assist Georgia Watch, the state’s leading consumer advocacy organization, in securing an important legal win that protects access to justice for Georgia consumers. In Titshaw v. Geer (2023), the Georgia Court of Appeals applied a 4-year statute of limitations to legal malpractice claims and barred consumers from pursuing additional claims, limiting their legal options. Recognizing the impact, Georgia Watch asked The Linley Jones Firm, P.C. to submit an amicus brief advocating for consumer rights to the Georgia Supreme Court. On Oct. 22, 2024, the Georgia Supreme Court overturned the prior decision, clarifying the statute of limitations for legal malpractice claims and confirming that consumers can pursue alternate recovery claims against former attorneys, in some cases extending the statute of limitations to 6 years. This ruling establishes critical precedent for victims of legal malpractice in Georgia. A huge thank you to Plaintiff’s attorney Michael Peacock for his outstanding legal work bringing this case, attorney Megan Boyd for her research and drafting, and Georgia Watch and its Board Chair Tedra Cannella for their steadfast advocacy. It’s a rare treat to spend time with other board-certified legal malpractice lawyers. This weekend’s convention of the American Board of Professional Liability Attorneys in Chicago was a great mix of top-notch legal education and collegiality. ABPLA President Justin Kahn succeeded in joining ABPLA under the umbrella of the National Board of Trial Advocacy which has administered board certification for other areas of legal specialty for 46 years. As a legal malpractice lawyer, I’m posting to remind folks that your case file belongs to you, not your lawyer. With rare exception, your lawyer is obligated to give you your entire case file upon request. This can be a bit complicated in the digital age. A case file used to consist of stacks of papers and folders in a Redweld folder (remember those?) Now it is likely to be bits of data that may be maintained in different locations, with many law firms using separate software and storage solutions for different aspects of the file. Although the form has changed, the lawyer’s obligation has not. Upon request, your lawyer is required to provide you with the file. And just as they were not allowed to charge you for paper copies, they are not allowed to charge you for the transfer of the file, whether that involves the cost of their technology team or even a USB drive. I have created the attached form letter that can be conformed and used by a client to request their file. Just be sure to send it in a way that provides proof of delivery. That can be an email, if it is acknowledged, or a tracked mail delivery. Then allow a few days to give the lawyer a reasonable time to get it to you. Years ago, my former legal malpractice client Bill Arnett gave me the opportunity of a lifetime to be a part of bringing the greatest Black artists in the American South to the attention of the world. Nine years later, I have just rolled off the board of the Souls Grown Deep Foundation where I was honored to serve as an officer and board member. Souls Grown Deep is dedicated to the mission of promoting Black artists from the American South and has successfully placed the most important works of these artists, collected and protected by the late Bill Arnett, in their rightful place in the world‘s great art institutions including the Metropolitan Museum of Art, the Royal Academy of Arts, the National Gallery of Art, and dozens more. My deep appreciation of art and these artists made this a passion project for me and led to many learning opportunities and unforgettable experiences in the art world. I have also been enriched by the relationships I formed in the process. It was a tremendous privilege to work with my friend, the late Bill Arnett, whose vision to preserve and promote this art made it all possible. Souls Grown Deep has been led and shepherded through these successes by its brilliant President Maxwell L. Anderson who applies his inestimable talents to the mission. These goals simply could not have been achieved without their efforts and those of Scott Browning, the Director of Collections, who has labored for the cause and contributed his knowledge and creative ideas from the very beginning. In more recent years, Curator Raina Lampkins-Fielder successfully infiltrated the European art scene on behalf of Souls Grown Deep artists, an effort that paid off with the spectacular achievement of a showing at the Royal Gallery among other accomplishments. Finally, I would be remiss if I did not recognize the tremendous contributions of Laura Bickford, a former curator whose talents are now enjoyed by the John Michael Kohler Arts Museum, and all of my dedicated fellow board members, most especially Michael Sellman, Richard Dial, Mary Margaret Pettway, Dr. Sellman, Valerie Cassel Oliver, Lola C. West, Bernie Herman and Jane Fonda, whose volunteer efforts made the progress possible year after year.
