Law firms' rate increases are "utterly bewildering" for GCs, says Jason Winmill, managing partner of Boston consultancy Argopoint. The federal judge overseeing Google's antitrust battle with Epic Games ruled today that while Google is not entitled to a long term stay of his order requiring it to open up its Play Store by Nov. 1, he thinks the 9th Circuit should have time to consider what the duration of a stay should be while it weighs Google's appeal. "This is not something I approve of," Judge James Donato said of Google's tactic of filing two emergency motions to stay his order, one in his court and one with the 9th Circuit. (While it is a bit much, this order giving Google only three weeks to make sweeping changes to the store is a huge blow for Google. They have a whole Fact Sheet about what's at stake.) Donato said he wouldn't be surprised if the 9th Circuit grants Google's request for a longer stay as it considers Google's appeal of the jury's verdict. "It would not be at all surprising if they grant the stay through the life of the appeal. That appears to be the M.O. in our circuit. But that's for somebody else to decide, not me," Donato said. "Comity and courtesy demand that our sister court take a look at it without feeling pressure from Google or the prevailing party."
