FM STERN SCORES A MEDIATION WIN IN NEW YORK FEDERAL COURT Frigon Maher & Stern LLP (FM Stern) recently achieved a successful resolution of all its client’s claims through court-mandated mediation related to a lawsuit filed in the Northern District of New York for breach of contract. FM Stern represented Plaintiff Kaiburr Systems LLC (Kaiburr), a corporation with its principal place of business and operations in Massachusetts that provides engineering solutions to its U.S.-based clients. Hodgson Russ LLP represented Defendant Tower 05, Inc., a systems integrator that provides development, engineering and manufacturing solutions, including technically-intensive design and full-build capability of industrial equipment. The litigation spanned over two years and all claims were fully resolved through the Court’s mandated mediation program.?Our client expressed that it was very pleased with the outcome. FM STERN SCORES A TRIAL WIN IN PENNSYLVANIA FEDERAL COURT Frigon Maher & Stern LLP (FM Stern) recently achieved a trial victory in Federal Court in Philadelphia for a Hong Kong-based design and manufacturer of mobile accessories and power electronics. FM Stern represented Plaintiffs Stuff Technology Limited and Stuff Electronics Limited (Stuff).?With over ten years of production experience, Stuff has become one of Asia's emerging manufacturer of a diversified range of power magnetic products and provides OEM and ODM contract manufacturing service to global customers. Khler Harrison Harvey Branzburg LLP represented Defendant For Your Ease Only, Inc. (FYEO), an Illinois-based consumer goods company that specializes in selling goods through QVC, Inc. and led by television personality Lori Greiner of Shark Tank. Clark Hill PLC represented Plaintiff-Intervenor Juno Financial LLC (Juno), a Colorado-based factoring company. The litigation spanned over four years.?After a five-day trial conducted before Judge Cynthia M. Rufe, the Court issued a bench decision that Stuff was entitled to judgment in its favor and against FYEO for breach of contract, establishing third-party beneficiary status, and rejected FYEO’s cross-claims for statutory and common law interpleader and Juno’s claim for tortious interference with contract.
