While some lawmakers are pushing for the finalization of this misguided legislation, Joe explains why the policy should not be implemented -- and why Bayh-Dole must remain intact. "The Bayh-Dole Coalition's Joe Allen, who helped craft the Bayh-Dole Act that houses the government's right to "march-in" on the patents of an invention developed using U.S. funding, says the Biden administration's lack of urgency to finalize the framework floated last year shows the administration might not believe in its potential either." "The fact that the Biden administration had this thing for eight months, they rolled it out with the White House touting it as an important tool to lower drug prices, and then they never pulled the trigger . . . We heard rumors it was going to come out imminently. It never did. And I don't know the reason, but my speculation is that the Biden administration realized this thing is a loser..." "Allen and the Bayh Dole Coalition, as well as others opposed to price being made an official factor to consider when determining whether to use march-in rights, have also said the draft framework is not equipped to help lower drug prices because most prescription drugs were not developed with federal funding. Finalizing the proposal would hinder innovation for drugs and other inventions across different business sectors, since such a change would also impact them, they say." The Bayh-Dole Coalition recently sent a letter to the Senate Judiciary Committee expressing our support for three bills scheduled for review during the committee markup on November 14, 2024: S.2220, the Promoting and Respecting Economically Vital American Innovation Leadership (PREVAIL) Act; S.2140, the Patent Eligibility Restoration Act (PERA); and S.4713, the Inventor Diversity for Economic Advancement (IDEA) Act. If passed, they will strengthen our patent system, which is the foundation of the Bayh-Dole Act that has done so much to enhance U.S. innovation at the time we need it most. Our letter highlights the significance of these bills and their potential to advance America's technological and economic leadership. "The PREVAIL Act, PERA, and the IDEA Act would enable key reforms to bolster U.S. innovation and reinforce the patent protections that undergird the world-class technology transfer system established by the Bayh-Dole Act. To address the ongoing challenges facing inventors and safeguard the future of American innovation, we sincerely urge [legislators] to preserve the integrity of these acts in their current form during the upcoming committee mark-up session." "These three pieces of legislation would significantly enhance clarity within our current patent system, bolster patent protections for American innovators, and supply essential data to ensure we leverage our nation's full creative potential. "Though the Bayh-Dole Act allows the federal government to “march in” and relicense patents under specified circumstances, none authorizes doing so based on price. Published in JAMA Health Forum, the study found: "The findings suggest that few drugs have solely march-in–eligible patents, so the overall effect of march-in on removing patent barriers to competition would be limited."
