Our colleagues across #SouthAsia and #SoutheastAsia gathered together to reflect on our 50+ years of work supporting law and justice in the regions. ? Check out our key learnings from our colleagues: ? ???Embracing community-led dispute resolution systems alongside formal ?justice ?? Parallel focus on wider justice ecosystem & access to justice for marginalized groups ?? Holistic view of justice "ecosystems" - formal, semi-formal, informal, customary
Over?the last?12 months we?have been taking?stock of our support to law and justice in South and Southeast Asia over, in some cases, more than 50 years. Last week we got together to look at what we have learned. Not easy to boil that down.?Some standout points for me:? ?? The similarity of entry points and evolution of programs even in a highly decentralised network of offices and teams: entry points occurred in a time of massive change in which?there was an opportunity to bed down?the rule of law?(Sri Lanka in the 1960s and 1970s; Indonesia’s Reformasi starting in 1998, Timor-Leste’s independence from 1999; end of Marshal Law in the Philippines in 1986; Constitutional change in Nepal in the 1990s) ?? Early efforts tended to focus on support strengthening of formal justice institutions?and the emergence of an independent legal sector?– reforming laws, training judges, lawyers and court staff,?working with law schools and?improving case management procedures ?? In tandem, there has been a strong focus on the wider justice ecosystem and the importance of protecting rights and enabling access to justice, particularly for marginalised groups. This has led to a strong focus on engaging with civil society,?building sometimes decades-long partnerships? ?? In several countries this led naturally to a greater focus on access to justice and from there to support to the growth and extension of socially and culturally appropriate forms of dispute resolution: to vast systems of community-led mediation in Sri Lanka and Nepal; to alternative dispute resolution through Shalish law in Bangladesh; village mediation in Laos and customary justice systems in Timor-Leste; support to Alternative Law Groups in the Philippines –?while?work on formal justice institutions continued? ?? In addition to impacts flowing from these efforts – improved formal institutions and greater access to justice, particularly for women, the poor and members of marginalized ethnic groups – it enabled an approach to engaging ‘formal’ and ‘informal’ justice systems in constructive ways, as and when it makes sense to do so (not due to some idealised imperative to link the two).? ?? And it resulted in TAF teams having a birds-eye view of the sector, one that diminishes the importance of that division and enables us to look at the interplay of many different actors and institutions – formal, semi-formal, informal, customary - in justice ecosystems.? ? It is little wonder then that, with the depth and breadth of that scope and the partnerships that goes with that, that some of our most senior program staff have been inspired to lead these efforts for 20 years or more.
