Partner Dan Stanner and Nelson Mullins Riley & Scarborough recently helped their client, a machine manufacturer, obtain a key ruling. As a result of the opinion issued by the United States District Court for the Northern District of Texas, only a single claim of strict product liability remains in a case filed by a worker against TDR’s client. Judge Ed Kinkeade ruled that the worker could not amend her complaint to add design defect claims against the manufacturer and dismissed her gross negligence claims.?
