With increased enforcement and the transition to?remote verification?options, now is a great time to ensure compliance. ???Key Steps for an I-9 Audit: ??Gather & Organize:?Collect all active employee I-9s and separate terminated employees’ forms (must be retained for at least 3 years from hire or 1 year after termination, whichever is later). ??Check for Errors:?Look for incomplete fields, missing signatures, or incorrect dates. Section 1 must be completed by the employee on or before the first day of work. Section 2 must be completed by the employer within?three business days. ??Verify Document Validity:?Ensure that work authorization documents were valid at the time of completion. Reverify for employees with expiring work authorization. ??Fix Mistakes Correctly:?Make corrections?without obscuring original entries?(single-line strikethrough, correction, initials, and date). Do NOT backdate. ??Use the Correct Version:?Always use the most up-to-date I-9 form. As of?November 1, 2023, the latest version is required. ??Review Remote Verification Rules:?If using?alternative document verification?(e.g., for remote hires under E-Verify), ensure you’re following DHS guidelines. ???E-Verify State Requirements??? While E-Verify is?optional?for most private employers, some states?mandate?its use: ???Required for all employers: Alabama, Arizona, Georgia, Mississippi, South Carolina, Tennessee, and Utah ???Required for public employers and/or state contractors: Florida, Idaho, Indiana, Louisiana, Michigan, Missouri, Nebraska, North Carolina, Oklahoma, Pennsylvania, Texas, and Virginia ???Local or industry-specific mandates: Some states and counties have industry-specific rules—always check your local laws! ???Pro Tip:?An internal audit now can help?avoid penalties later.
