Brace yourselves for a slew of AI legal headlines this year. There is much activity at the federal level related to the incoming administration, which we will address in coming posts. Meantime, know that state AGs (and potentially federal regulators, depending on enforcement priorities) have gone after an AI platform and its customers on antitrust grounds. The regulators object to the use of customer data to train the AI, which is then used by the customer base to establish pricing. The theory is that this amounts to illegal price collusion among the customers of the software platform. It is going to be a wild ride. If you use an AI in pricing decisions, it is worth keeping an eye on this. #ai #smallbusiness
