It's here! Applications are online for Biden’s?Parole?in Place?Program?for Undocumented Spouses of U.S. Citizens. Starting today, August 19, eligible undocumented spouses of United States citizens can begin applying for Parole in Place. We urge anyone who believes they may be eligible to contact us or another experienced immigration attorney right away to have a thorough eligibility screening. If eligible, we're recommending filing asap because this program will likely face legal challenges or could even be canceled under a new presidential administration. But, an approved or even pending application, could preserve an applicant's rights! We cannot know for certain since this is new and untested, but our sense having attended liaison and informational meetings, is that USCIS has the desire to move and approve these applications. I wish I felt more optimistic about Biden's Executive Order intended to benefit undocumented persons who meet certain criteria. https://lnkd.in/e7bUaAMZ It so far raises two main concerns for me: (1) notario fraud will be on the rise, which will damage the very people the initiative purports to help, and (2) the Executive Order will get shut down by a lawsuit in an unfriendly court jurisdiction as happened for initial DACA applications. This, too, will be harmful for the very people the order supposedly seeks to help. Certainly the Biden administration knows of these flaws, so this sadly isn't supposed to be a real solution. I say this because Biden has failed to promote real solutions for undocumented persons so far after 3+ years. Let’s call this what it is: a political maneuver in election times. And let's keep pushing for real solutions!

This training will be really helpful to immigration attorneys! Count this among the skills we didn't get in law school, such as a psychological and trauma-informed approach to interacting with clients and caring for ourselves, and how to effectively run a business...to name a few. Working with Admir on the country conditions-side has boosted my confidence making an assessment about a potential client's eligibility for asylum and allowed me to feel confident that my evidence was not only addressing my client's claim in a pinpointed way, but not inadvertently harming the claim, or detracting from the main arguments. (Full disclosure, Admir is my husband. ?? It doesn't change my comments here!)

https://lnkd.in/euDNUnEf The White House announced Deferred Enforced Departure (DED) for 18 months for Palestinians. What do we know about DED so far? - It will allow for individuals who were physically present inside the U.S. as of February 14, 2024 to apply for a work permit. - DED is not an immigration status, or a path to any permanent status. - It appears DED can overlap with some other type of status, for example F-1 student status. - DED is different from Temporary Protected Status (TPS).

https://lnkd.in/emN2_a7z "The new bill, he says, reverts to the spirit of the Trump presidency which took a notably hard line on immigration, introducing Title 42, a pandemic-era policy that allowed for the rapid expulsion of migrants.... Other reforms included in the deal are fast-tracked decisions on asylum cases, limits on humanitarian parole, expanded authority to remove migrants from the US, stricter consequences for illegal crossings and even $650m to build or reinforce miles of border wall." This is extremely troubling, bad for immigration and humanity. Key takeaways: --US senators have unveiled a highly anticipated cross-party deal that would give more money to Ukraine and Israel?in exchange for even more inhumane border control measures. --Since President Biden took office in January 2021, more than 6.3 million migrants have been detained crossing into the US illegally between points of entry, which has created major processing backlogs. It has also created a widespread political myth of a "border crisis." -- Asylum seekers seeking to enter via the southern border are yet again turned into political pawns. They are the price Democrats are willing to pay for more military aid to Israel and Ukraine. -- The real solution lies in changing the false border narratives, hiring more Asylum Officers, immigration judges and investing in rights-based social and legal services for people who have been traumatized over and over again. -- What's maybe the most troubling is that top Republicans have called the bill "dead in the water." These Republicans want to wait until Donald Trump is elected and enact what would be the most restrictive and inhumane immigration policies in the history of the country.
