In the seemingly never-ending legal saga associated with the Corporate Transparency Act (“CTA”), a different panel of the Fifth Circuit Court of Appeals has vacated the stay of the preliminary injunction against enforcement of the CTA previously issued by the Court’s motions panel. This effectively reinstated the preliminary injunction as of December 26, 2024. However, on December 31, 2024, the U.S. Solicitor General, on behalf of the Financial Crimes Enforcement Network, filed an application for a stay of the preliminary injunction with the Supreme Court of the United States. On January 3, 2025, Justice Alito, who handles emergency matters from the Fifth Circuit, requested a response to the Solicitor General's application by 4:00 pm EST on Friday, January 10, 2025. The Fifth Circuit Court of Appeals has stayed the nationwide preliminary injunction of the Corporate Transparency Act which means that the filing of Beneficial Owner Information Reports are once again due in January.
