If the Trump administration were to defy the courts, they would be crossing perhaps the most fundamental line demarcating constitutional democracy from autocracy. ??? As Stanford Law School's Rule of Law Impact Lab explained in its report last year, Mexico's September 2024 judicial overhaul--which seeks to replace nearly 7000 sitting judges with those elected by popular vote--is a blow to judicial independence and the rule of law in the country. Democracy starts in the classroom. Laws that restrict classroom instruction about topics like race and gender, and ban books, create a culture of fear and promote discrimination. Yesterday, President Trump issued an executive order that would effectively censor teachers in classrooms nationwide, modeled after several states already implementing these laws.?Last year, the Rule of Law Impact Lab worked with Human Rights Watch and Florida Rising to study the impacts of Florida’s education laws and policies, court and administrative records, and media accounts. ?? The Rule of Law Impact Lab at Stanford Law School expresses deep concern over the recent actions of Mexico’s Electoral Tribunal, which violated a Supreme Court injunction and effectively transferred judicial nominations to political powers. This confirms that the implementation of Mexico’s judicial reform is deeply flawed, further eroding judicial independence and undermining the rule of law. In our May 2024 report, we warned that this reform—replacing nearly 7,000 sitting judges with elected ones—violates international judicial independence standards.
