Energizing and informative day at the IAB State Privacy Law Summit with our co-sponsor Frankfurt Kurnit Klein & Selz. What was your biggest takeaway? Some highlights from the day's discussions ?? State investigations preparedness: - State AG offices actively collaborating on enforcement approaches despite varying state laws, sharing resources - Don't wait for investigation letters - start compliance work now, especially regarding third-party tracking disclosures - Request clarification calls with regulators before formal responses - silence typically amplifies issues - Be prepared for varying investigation depths: some resolve quickly, others require multiple rounds - Focus on demonstrating corrective actions during resolution - Plan communications strategy early - complaints/press releases will typically publish without preview - Honor all commitments, maintain clear audit trails, implement proper compliance frameworks, and document adherence to terms Privacy litigation trends: - CIPA litigation focus shifting from session replay to pixel tracking & data sharing practices - Consent might not be enough. CA requires privacy waivers to be truly "knowing & intentional";?per plaintiffs' firm Pacific Trial Attorneys generic notices don't suffice - Avoid blanket statements in privacy policies: align disclosures with actual practices to mitigate risk of #UDAP claims Best practices for third-party technology management: - Map data flows and understand downstream pixel implications, especially for cross-context advertising - Oregon's third-party disclosure requirements in effect, with more intensive requirements from MN (July 2025) and RI (Jan 2026) on horizon - Factor in operational details like your organization's holiday blackout periods for website updates Thank you to all the panelists and moderators! ??
