FMLA and PFML provide employees time off for various reasons, including their own serious health condition, the birth of a child, and the serious health condition of certain covered family members. From time to time, an employer will have reason to question whether an employee is using FMLA and/or PFML for a legitimate reason, especially when the employee is approved to take the leave intermittently for chronic, unpredictable conditions. Employee handbooks can be invaluable tools for employers, but they can also create legal liability when they are missing legally required policies or not up to date. In the last year alone, there have been notable changes at the state and federal level that require employers to update their handbooks to avoid liability for noncompliance.
