The White House Council on Environmental Quality (CEQ) has proposed rescinding its regulations implementing the National Environmental Policy Act (NEPA), a 1969 statute that requires federal agencies to consider the environmental effects of their projects or actions. CEQ also issued guidance to agencies on compliance with NEPA in the absence of the CEQ regulations, and on the implementation of President Trump’s Executive Order (EO) 14154, Unleashing American Energy, which directs agencies to revise or establish their own NEPA procedures to expedite and simplify permitting processes. Last week, in Washington D.C., SPR Principals Pamela Esterman, Daniel Riesel, and Elizabeth Knauer co-chaired the 55th annual ALI CLE Environmental Law Conference, which was co-sponsored by the Environmental Law Institute. SPR's founder, David Sive, chaired the first conference in 1970, and SPR attorneys have chaired the Environmental Law Conference ever since.?The Firm takes pride in its continued leadership and organizational efforts that contribute to the conference's success year after year. ? Last Friday, SPR attorneys Michael Bogin, Joyce Kung, and Ahlia Bethea co-presented "Ethical Challenges in Environmental Law" alongside Thomas Richards from NYS Department of Environmental Conservation and Michael Nilson, PE, MBA, LEED AP from Langan Engineering & Environmental Services. Their engaging session was part of the The Jeffrey G. Miller National Environmental Law Moot Court Competition (NELMCC) at Elisabeth Haub School of Law at Pace University. New York State is proposing significant amendments to the State Environmental Quality Review Act (SEQRA) regulations to align with the Environmental Justice Siting Law (EJSL). Announced on January 29, 2025, these changes implement the EJSL requirement for agencies to assess whether projects may cause or increase a disproportionate pollution burden on disadvantaged communities as part of the SEQRA review process. The draft amendments also expand the Type II action list, exempting certain residential and renewable energy projects from SEQRA review, and strengthen climate change considerations in Environmental Assessment Forms (EAFs). ?
