Important work. I hope we're pleasantly surprised and the new Administration keeps the lines of communication open. They claim to not oppose all immigration and there are some hints in Project 2025 that they want to make the immigration system function more efficiently. If that's genuine, then continuing to meet with stakeholder groups is one of the best ways to get feedback on what works well and what doesn't in the immigration system.
Tis the season for government liaison meetings! We had a wonderful meeting with the National Visa Center in Portsmouth, NH yesterday. I'm always grateful for the candor and collaboration from the government agencies who play an important role in our clients' immigration journeys.

Founding Partner Greg Siskind has been featured in a The Times Of India article discussing Donald Trump's proposed executive order, which seeks to end automatic citizenship for children born in the U.S. to parents who are neither citizens nor lawful permanent residents. Siskind states, “This will certainly be litigated as it violates the 14th Amendment. We will have to see if they go so far as to exclude children of people legally in the U.S.” Click below to hear more about how this will impact over 1 million Indians waiting in the green card backlog. https://lnkd.in/ewQWAugy

In the news! Our partners have recently been quoted in three articles discussing the prior immigration status of Elon Musk with Adam Cohen weighing in on key legal questions in The Washington Post and Greg Siskind providing additional analysis in a follow-up article on CNN that dives deeper into the issue. Their evaluation brings clarity to this widely discussed topic, tackling some of the complex legal angles at play. We’re proud to contribute informed perspectives on high-profile cases impacting public understanding of immigration law. Last week, I had the distinct privilege of attending the Fall 2024 AILA Department of State Liaison Committee meeting in Washington DC. It is always fun spending time with my AILA colleagues, and I always learn more than expected when we engage with the government. I fully appreciate the candor and mutual respect between AILA and the State Department, and I look forward to future meetings!

The only good news here is that all numbers were used in these categories compared to past years when the government failed to process enough and numbers were wasted.
A few weeks ago, I shared that all green cards in the EB-3, Other Workers, and EB-5 (unrestricted) categories were exhausted for the 2024 Fiscal Year. The US State Department advised in its September 2024 Visa Bulletin that there is strong demand and low supply across all the employment-based (EB) green card preference categories and that they expect all the green cards available for this year will be used. If a category becomes unavailable, the government cannot approve green cards in that category through the end of the Fiscal Year (9/30/2024), though we can still file applications per the appropriate Visa Bulletin and USCIS policy. The 2025 Fiscal Year will begin on October 1, 2024, and that visa bulletin should issue in mid-September. It will be interesting to see how things move (or don't) for the beginning of the new year.

In a recent Bloomberg Law article, Partner Greg Siskind discusses his ongoing efforts to advocate for Russian Fulbright scholars stranded in the U.S. due to the war in Ukraine. These scholars are facing complex legal and bureaucratic challenges, unable to return to Russia due to persecution risks and hindered by the current immigration policies. He has been pushing for a blanket waiver of the home residency requirement or its cancellation due to the crisis. The situation underscores the critical need for policy changes to protect those caught in the crossfire of international conflicts. We encourage you to read the full article and learn more about this important issue. https://lnkd.in/ernBsE97
