  • On Tuesday, Denver’s City Council voted to retroactively ban new gas stations in certain areas—including sites where developers have already invested significant time and capital. ? With a retroactive May 13, 2024 enforcement date, the ordinance invalidates projects submitted after that time, potentially costing property owners and developers millions in sunk costs. ?? “This is yet another straw breaking the camel’s back for commercial real estate in Denver,” said Kathie Barstnar of NAIOP Colorado, highlighting concerns over regulatory stability and investment risk.   • Exciting progress at the Ball Arena site! ??? The South Platte River Committee has unanimously moved forward with a rezoning proposal near Ball Arena, aligning with the city’s vision for a vibrant downtown. CRL Associates, Inc. has been working alongside the Scott family—stewards of the property since the 1970s—to develop a plan that integrates affordable housing and supports the Ninth Avenue Peace and Healing Garden at Auraria. As Sean Maley of CRL shared, “We appreciate the thoughtful feedback that challenged us to refine our approach and bring forward a proposal that better reflects the community’s priorities.” Collaboration like this is what moves cities forward. Clearer rezoning criteria – Streamlines the approval process by removing outdated language and standardizing evaluations. ? Expanded public notification – Tenants, not just property owners, will now receive notices, increasing community awareness. ? Earlier notice posting – Developers must post rezoning signs earlier, giving the public more time to engage. ? Required outreach documentation – Applicants must now show proof of community engagement as part of their submission. What This Could Mean for Developers: ?? More upfront communication – Early and thorough public engagement will be essential. ?? Clearer expectations – Standardized criteria could provide more predictability in rezoning decisions. ??   • The evolution of our downtown continues and it remains a story of highs and lows. Vacancy rates for office remain high, but leasing activity was up in Q4, and pedestrian traffic is back at about 85% of pre-pandemic levels. Looking ahead this year, we're eager to see how the completion of work along 16th Street and the infusion of investment kicking off with the DDDA will impact growth, leasing rates, visits and overall sentiment towards our center city.
