A citizen of the Cherokee Nation, Senior Counsel Anthony Wingrove is one of six known native attorneys in the United States qualified to work with the USPTO on behalf of the National Native American Bar Association to address critical patent law and indigenous human rights issues. In celebration of Native American Heritage Month, Anthony explains a recent landmark moment in his work. ? SHOOK: Tell us about your work with NNABA. ANTHONY: I worked on behalf of NNABA and 574 American Indian tribes and Alaska Native entities preparing comments in response to the USPTO Notice of Tribal Consultation published on Oct. 24, 2023, regarding WIPO Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore (IGC) negotiations. We wanted to enable NNABA to engage effectively with the USPTO and contribute meaningful comments. These contributions were pivotal during the consultative process and significantly shaped discussions in two invite-only meetings with USPTO staff. ? As a result, NNABA was able to influence U.S. positions in the negotiations of the genetic resources treaty at the WIPO diplomatic conference in Geneva earlier this year. The outcomes of these negotiations, culminating in a treaty that the U.S. delegation has agreed to, mark a historic step in the evolution of international IP law and the recognition of Indigenous Peoples’ rights. ? SHOOK: What's your current role with NNABA?? ANTHONY: I’m co-chair of the Intellectual and Cultural Property Committee. I participated in an Oct. 2024 discussion with USPTO along with several departments of the federal government and other Native stakeholders as part of the 2024 WIPO Diplomatic Conference to Conclude and Adopt a Design Law Treaty in Riyadh, Saudi Arabia. Native stakeholders included representatives of the Tulalip Tribe, The Implementation Project at the University of Colorado Boulder, the Coalition of Large Tribes and their counsel. ? I also wrote a response to the discussion noting that the US Government and USPTO failed to meet minimum tribal consultation standards for the DLT. Free, Prior, and Informed Consent is the human rights standard that should apply to the grant of IP that incorporates traditional knowledge (TK), traditional cultural expressions (TCEs) and genetic resources (GRs). Mandatory disclosure is required for Indigenous Peoples to have a meaningful opportunity to participate in the stewardship of their TK, TCEs and GRs in the IP system. ? SHOOK: Do you have plans to continue this work? ANTHONY: Given the lack of IP experience at these Diplomatic Conferences, several members of the Indigenous Caucus asked me to participate in future DipCons to deliver statements and introduce proposals for the treaties' text.
