Check out this insightful article by Jonathan Smith, where he analyzes forum defendants' ability to take advantage of "snap removals" to federal court. In Anaya v. Schlumberger Technology Corp., No. 24-20170, 2024 WL 5003579 (5th Cir. Dec. 6, 2024), a foreign plaintiff filed suit against a lone forum defendant, who removed the case before being served with process. The Fifth Circuit held that the pre-service removal by a forum defendant was proper, opening the door for forum defendants to effectuate snap removals prior to being served.
