It's true. A recent study conducted by the U.S. Bureau of Justice Statistics (BJS) found the following: ?? Plaintiffs prevailed in roughly half of the cases that proceeded to trial. ?? The likelihood of success for plaintiffs varied significantly based on the type of case. ?? In car accident trials, plaintiffs secured compensation 61% of the time. ?? However, in medical malpractice trials, plaintiffs won just 26% of cases. So when does a case actually make it to trial? Well, Some cases may never settle due to disagreements between the victim and the responsible party or other complications. In these instances, there isn't enough mutual understanding for the two sides to reach an agreement. A trial is then called.
