Earlier this year, the Centers for Medicare & Medicaid Services (CMS) announced significant changes to the reporting requirements for workers’ compensation settlements, effective April 2025. Semmes principal Lawrence Giambelluca authored an article, with assistance from summer associate Kamryn Washington, on the topic to explain the changes and their ramifications to employers.? ? New Reporting Requirement:?All Workers' Compensation Medicare Set-Asides (WCMSA) funding must be reported to CMS via the Section 111 (S111) process. ? ? MSA Approval Review Thresholds:?CMS will continue to review WCMSAs that meet the $25,000 threshold, but reporting through the S111 process is mandatory regardless. ? ? Detailed Reporting:?Information on settlement amounts, coverage years, and funding methods (lump-sum or structured annuity) must be reported. ? ? Penalties:?Fines up to $365,000 for failing to report ongoing responsibility for medicals (ORM) or Total Payment Obligation to the Claimant (TPOC) within one year. ? ? In November 2023, a split three-judge panel of the Fourth Circuit Court of Appeals struck down provisions from Maryland’s Firearm Safety Act of 2013 requiring a handgun qualification license as a condition for obtaining a handgun, with the majority finding that it was unconstitutional under the Supreme Court’s new test for Second Amendment challenges espoused in New York State Rifle & Pistol Association v. Bruen. ? The fate of the statute is now up in the air again; however, after a majority of the judges on the Fourth Circuit recently voted to grant en banc review of the panel’s decision and rehear the case. ?
