Thank you to @CaitlinJung from Capitol Advisors for this update. #Superintendents #SchoolBoards #HumanResourcesManagement #SEAC Today Governor Newsom once again vetoed a bill that would have established an internal first right of refusal for classified school employees. A high priority bill for the California School Employees Association (CSEA),?AB 2088?would have required K-14 employers to offer any classified vacancies as a right of first refusal for 10 business days to interested current regular nonprobationary classified employees who meet the minimum job qualifications, before the employer could offer the position to an external candidate. ? Like with its predecessor,?AB 1699, AB 2088 was a focus of a broad opposition campaign by LEAs and statewide education management organizations, including ACSA, CSBA, SEAC, and SSDA. While AB 2088 was slightly different than last year’s effort, education groups remained concerned with the bill’s underlying policy?and the impact it would have on students and staff. ? In his?veto message?for AB 2088, the Governor wrote: ? “This bill is significantly similar to Assembly Bill 1699 of 2023, which I vetoed, and several of the same concerns remain. In particular, like Assembly Bill 1699, this bill may have unintended consequences that are not in the best interest of students. As noted previously, this issue is already bargainable and several local bargaining agreements have such provisions in place. Placing specific requirements in statute - as this bill does - may make it more difficult for local processes to develop an alternative that best meets the needs of the district, employees, and students.” If the proponents of AB 2088 want to pursue this effort again in the new legislative session, they will have to find a new champion. The author of both AB 1699 and AB 2088, Assembly Member Kevin McCarty (D-Sacramento), termed out this year and will not be back in 2025. ? The Governor still has a week left to act on any other bills remaining on his desk. Once the September 30th?signing deadline has passed, we will be sending out our annual Changes in Law series, sorted by broad subject areas, that will walk through the legislation signed into law this year that will impact school operations. ?
