This week the Higher Regional Court of Hamm heard the highly anticipated climate case brought by Peruvian farmer mountain guide Saúl Luciano Lliuya against the German energy company?RWE. A decision is expected on April 14, 2025. By reaffirming the?polluter pays principle,?the Court shifted the legal dial, not just in Germany but worldwide: the era of holding fossil fuel corporations accountable for climate-related damage has begun. “This hearing marks a turning point in climate litigation and the fight to hold big polluters accountable. A fossil fuel giant being forced to answer in court for its role in climate harm is a seismic shift—signaling the beginning of the end of the era of industry’s impunity.?In a desperate move to evade accountability, RWE’s legal team tried to persuade the judges to overturn the precedent they set in 2017?by?resorting to the same worn-out arguments the polluting industry always uses to evade responsibility. It is ever more evident how deeply concerned the fossil fuel industry is that the Court’s past and future rulings will reaffirm major polluters’ responsibility for climate harms,” commented CIEL’s Senior Attorney, Sébastien Duyck at the end of the hearings. “These hearings send a powerful message—not only to the dozens of similar ongoing cases around the world but to communities everywhere that justice is coming within reach. As a matter of law, major polluters’ contributions to climate harm carry legal consequences. The fossil fuel industry and its financial backers should take heed: there is no escaping climate accountability. In the rising tide of climate litigation, the fossil fuel industry is a sinking ship. This is terrible news. Big corporations using the courts to not just silence critics, but destroy them.
Yesterday's verdict in the Energy Transfer v?Greenpeace?lawsuit is a major blow to Greenpeace, our partner and friend, and to the environmental movement as a whole. It highlights the growing trend of big polluters using the legal system to intimidate and silence critics. The message they seek to convey is a deeply chilling one: that no organisation that challenges polluting industries is safe. This is part of a deeply worrying pushback against the fundamental rights of freedom of speech and protest - in the US and beyond. If we are to change the course of our rapidly warming world, we must be able to call out those reneging on their responsibilities, whether companies or governments. There is absolutely no place for SLAPP (Strategic lawsuits against public participation) suits that tie up environmental organisations for years and divert them from their core purpose. Our collective focus must be on safeguarding the future of our planet.??

Basically a little more than 10% of your power bills are guaranteed profit for Duke, FPL, and TECO. And they are going up even more. Florida's Public Service Commission has approved rate hikes for Duke Energy and TECO (Tampa Electric), adding $360 - $490 to annual bills. Florida Power & Light is next up at the table, with their $10,000,000,000 rate hike request. Yes, that's ten billion dollars, biggest request in history. Note that these companies look for a 11.5% return on equity - profit - higher than the national average. They are private monopolies with guaranteed profits. Big energy group's case against Greenpeace goes to the jury in North Dakota. Here's an instance of wealthy corporations using the courts to shutdown environmental organizations who get between them and their profits. Energy Transfer accuses Greenpeace of defaming them by signing (along with 500 other signatures) and sending a letter to banks funding their projects.
