As we enter the holiest month of the Islamic calendar, we highlight Ramadan, a significant time for reflection, fasting, and spiritual growth for those who observe it. Ramadan is a month dedicated to communal prayer, self-discipline, and acts of charity. During Ramadan, fasting takes place from dawn to sunset, with the fast being broken after the sunset prayer, often shared among family and friends with a special meal called if?ār. As described in the Qur?ān, eating and drinking are allowed once the “white thread of light becomes distinguishable from the dark thread of night at dawn.” The end of Ramadan is celebrated with Eid al-Fitr, a joyful occasion marking the conclusion of the fasting period. Bethany Barrese and Michael A. Amato break down the recent Appellate Division decision in Rockefeller Univ. v. Aetna, which highlights how policyholders can successfully plead bad faith and consumer protection claims under New York law. In Rockefeller, the Appellate Division reaffirmed the trial court’s holding that policyholders can adequately plead bad faith claims when they allege conduct and damages distinct from a breach of contract claim. The Appellate Division also clarified that New York’s General Business Law § 349 can apply when insurers engage in deceptive practices that impact multiple policyholders.
