    The federal courts have recently released the first Annual Report on the Judiciary Workplace detailing the steps taken to protect employees from discrimination, harassment, retaliation, and abuse while providing effective pathways for resolving workplace concerns. Some highlights from the report: ?? Enhanced Dispute Resolution Plans: All federal courts have implemented comprehensive employment dispute resolution (EDR) plans, offering employees options like informal advice, assisted resolution, and formal complaints. ?? Confidential Support: Trained professionals, including Directors of Workplace Relations, now provide confidential advice and guidance across court circuits. ?? Transparency & Accountability: Data on Judicial Conduct and Disability (JC&D) complaints shows that employee-initiated complaints remain rare, while most workplace concerns are resolved early through mutual agreements. ?? Increased Engagement: EDR usage has nearly doubled since 2021, reflecting growing awareness and trust in these resources.   • Congratulations to Senior Associate Matthew Routh on securing a win in the appellate division. SBAGK represented the defendant/respondent in the foreclosure action. The Appellate Division, Second Department, upheld the Supreme Court's decision to deny the plaintiff’s motion for summary judgment on the central issue of standing—a fundamental element in foreclosure cases. Highlights of the case: -The court reaffirmed that a plaintiff must clearly establish standing to foreclosure by demonstrating it was the holder of the note at the time the action commenced. -Despite the plaintiff's reliance on a note endorsed in blank, the court found issues with its attachment and evidence of possession, ultimately deeming the evidence insufficient to meet the legal standard. -Importantly, the court rejected evidence from the plaintiff's loan servicer.     A New York housing nonprofit, the Center for NYC Neighborhoods (CNYCN), has received a $1 million anonymous donation to support its program aimed at helping seniors and people with disabilities remain in their homes. The funds will allow the nonprofit to provide zero-interest loans of up to $50,000 to help pay off debts, such as overdue maintenance fees, taxes, or mortgage payments that could lead to foreclosure.     The New York Court of Appeals dismissed an appeal challenging the constitutionality of the retroactive application of the Foreclosure Abuse Prevention Act ("FAPA"). On September 12, 2024 the court ruled that no constitutional issue was directly involved in the case, leaving the question of FAPA's constitutionality unresolved. The case in question involved a mortgage foreclosure action where the plaintiff's complaint was dismissed due to the timing rules under FAPA. MTGLQ Invs., L.P. v. Singh, 2024 NY Slip Op. 74046 (Sep 12, 2024) While some state and federal courts have disagreed on the retroactive application of FAPA, none of New York’s intermediate appellate courts have made a definitive ruling on its constitutionality. The New York Attorney General’s Office has intervened in several cases to defend the law, but the issue remains unsettled, with several appeals still pending in the Second Department. FAPA remains under judicial scrutiny, but for now, it survives another day as the question of its constitutionality continues to unfold.
