Key takeaways session on discovery of hyperlinks, collab tools and video--at Arkfeld EDD conference: 1. Large variety of types of hyperlinked files. Also many complexities e.g. nesting: hyperlinks within linked files; or links to things that are not documents; versioning of linked data. 2. Court is generally not going to let you get all the data linked. Some courts order a reasonable or specific number of linked files allowed to be produced. 3. Key issue is when do you pull or find, at beginning or later when key docs identified, and learn what's inevitably missing. 4. Must address across discovery process starting with custodial interview: start with is client and custodian using links. 5. Should we discuss hyperlinked data in 26(f) and ESI protocol if there is one? Discussion between counsel on preservation of hyperlinks and data tends to recur frequently. 6. Panel consensus better to have discussion between counsel on hyperlinked data early to avoid cost and delay. 7. Common to hit need for an expensive upgrade license to get data via hyperlinks. Often need vendor to do preservation and collection work. #hyperlinks #ediscovery #sandlineglobal Sandline Global
