?? California’s New GenAI Legislation: Key Updates for AI Developers and Consumers ?? Last month, California Governor Gavin Newsom signed several new generative AI laws that will have significant implications for AI developers, companies integrating AI, and every-day end-users alike. Here's a quick breakdown of some of the key legislation: ?? For AI Developers: - AB 2013 – AI Training Data Transparency: All AI developers, regardless of the size of the company or project, must publicly disclose detailed information about the data used to train their AI models. - SB 942 – Provenance and Detection Tools: Requires AI providers to offer tools that verify if content was AI-generated, with clear disclosures to ensure transparency. ?? For Companies Integrating AI: - AB 1008 – AI & CCPA Compliance: Expands the definition of personal information to include encrypted files and AI outputs. This means all personal information—including data processed or output by AI systems—must be handled in compliance with the CCPA. - AB 2602 – Digital Replicas Consent: Protects individuals from being replaced by AI replicas without explicit consent, critical for industries like entertainment. ?? For Consumers: - AB 2355 & AB 2655 – AI in Political Ads: Political ads using AI must include clear disclosures, and online platforms must block or label deceptive election-related content and provide mechanisms for reporting such content. - AB 1836 – Digital Replicas of Deceased Individuals: This bill prohibits the unauthorized commercial use of a deceased person’s voice or likeness via digital replicas without prior consent, protecting their legacy and preventing exploitation. - SB 926 & SB 981 – Protection from AI-Generated Explicit Content: Social media platforms must swiftly act on reports of unauthorized AI-generated intimate images to curb the influence of manipulated media and deepfakes as genAI becomes increasingly ubiquitous. - AB 1831 & SB 1381 – Expanding CSAM Statutes: These laws make it illegal to create or distribute AI-generated content depicting minors in sexual acts. Severe penalties, including felony charges, address the growing threat of AI-enabled exploitation, closing legal loopholes and ensuring the protection of minors. ??
