As the HHS Office of Inspector General issues updated compliance guidance, we look to their requirements on reporting. Based on the guidelines for Nursing Facilities, they state that an entity needs at least one reporting path independent of the business and operational functions that permits individuals to report concerns anonymously.?This option should be posted throughout the entity. The Department of Justice is further incentivizing whistleblowers through their three year pilot project. DOJ’s program is focused initially on four areas as detailed in their Fact Sheet. In a significant move, the SEC announced that seven public companies have agreed to pay over $3 million in penalties for using employment, separation, and other agreements that impeded whistleblowers from reporting potential misconduct. These agreements required employees to waive their right to whistleblower awards, violating Rule 21F-17(a), which protects individuals who report securities law violations to the SEC.
