The Trump Administration has issued Executive Orders aimed at strict immigration law enforcement, including the deportation of individuals who are present in the United States without lawful status. These EOs include a policy reversal that previously restricted Immigration and Customs Enforcement (ICE) in designated "protected" areas. ICE officers are once again allowed to make arrests in places including schools, churches, hospitals, and shelters. ICE officials are also allowed to question people in public spaces, such as public transportation. In light of these anticipated increased enforcement actions and ICE activities, we are sharing the attached "Know Your Rights" flyer, prepared by the American Immigration Lawyers Association (AILA). Newsflash for December 2024 Anticipated Travel Ban Post Inauguration President-elect Trump has expressed his intention to impose more restrictive immigration policies and measures that are anticipated to impact not only undocumented persons, but those in lawful immigration status. These measures include likely travel bans once the President-elect takes office on January 20, 2025. To avoid potential risks, several colleges and universities this week have issued advisories to their international students, scholars, and staff to avoid travel over winter break or to return to the United States before January 20th. While we do not know any specifics at this time, it is likely that the new administration will re-implement the “Muslim Ban,” which first restricted entry to the United States from certain countries with majority Muslim populations in 2017. We expect that this list will expand to include citizens from other countries that the incoming administration believes pose security risks to the United States, thus extending travel bans to citizens of non-Muslim majority counties.?? Given the uncertainty post-January 20, we recommend that nonimmigrants and other non-citizens avoid travel and plan to be physically present in the United States before January 20, 2025.??This is particularly the case for individuals in lawful status who are intending to apply for visa stamps while abroad, as there could be visa processing delays at consular posts and more administrative processing that would result in some persons being unable to return to the United States before travel bans take effect.?For those outside of the United States or those traveling abroad over the upcoming holidays, we encourage them to return by mid-January. In light of the U.S. Presidential election results, we understand that many of our clients and their employees may be anxious about the anticipated Trump Administration immigration policies. Based on the previous Trump Administration, we can expect a rescission of deferential policies implemented under the Biden Administration, an increase in the scrutiny of cases including Requests for Evidence (RFEs), and further delays in processing times.? Our firm will continue to monitor changes in immigration policies and adjudication trends. We remain committed to advising our clients on how to optimize their requests for immigration benefits, how their employees can maintain lawful status, and how to manage immigration programs. For now, RSST Law Group is making the following recommendations for our business clients: - Identify any employees who are working pursuant to an EAD card that is based on a protected status, such as DACA or TPS. We will then be able to determine if such employees may benefit from changing status to a lawful nonimmigrant status; - Initiate extension of status processes for employees who are eligible to extend in the next six months; and - Initiate employment-based green card cases for eligible employees as soon as possible, so that we may get applications and petitions in queue in anticipation of longer processing times.?
