We’re proud to announce a significant win for our client, U.S. Merchants, in a long-standing trade dress infringement case brought by National Presto Industries. ? On November 12, 2024, the Eighth Circuit upheld the District of Minnesota’s earlier decision, finding that National Presto lacked trade dress in its parabolic heater design. The appellate court had "no difficulty" affirming that National Presto’s trade dress claim was unsupported, citing the lack of direct consumer evidence and the prevalence of similar components used by competitors. ? This ruling concludes nearly six years of litigation, reinforcing U.S. Merchants' ability to compete and innovate in the marketplace without disruption. ?
