With JP Morgan Chase now facing a lawsuit similar to those against J&J and Wells Fargo, fiduciary responsibility in prescription drug management remains under the spotlight. A third lawsuit targeting plan sponsors for breach of fiduciary duty on their prescription drug plan procurement - Johnson & Johnson, Wells Fargo and now JP Morgan Chase have been targeted. All 3 lawsuits are nearly identical and follow this script: ?? There are drugs defined as specialty drugs being shipped from the PBM's specialty pharmacy to patients. ?? The PBM is running an exclusive specialty arrangement forcing patients to fill these drugs at their specialty pharmacy and not allowing competition. ?? There is no Usual and Customary price at the pharmacy so the PBM can charge any amount for the drug. ?? The PBM bills the plan significant markups over and above fair market prices for those drugs available at other pharmacies. ?? There must be some accusation that the employer should have known better - in this case it is their membership in HTA and PBGH (a bit of stretch since neither are experts in pharmacy). Here's the uphill battle for these lawsuits: ? The PBM offers contractual guarantees that, in the aggregate, provide discounts to the plan well in excess of the initial billed amount. ? The aggregate contracting of the client with the PBM likely provides discounts and rebates well in excess of the PBM's that may not own their own specialty pharmacy. These drugs make up a very small amount of total spend. Here's what's a little different about this one: ? CVS launched it's own co-branded Humira biosimilar that is not the lowest possible cost for a plan. What implication does that have? The message should remain the same for employee benefit consultants: ?? Run a formal procurement process for PBM contracts AT LEAST EVERY OTHER YEAR. Any 3 year contract should have a market check provision in year 2. ?? Ensure you are getting bid specific specialty and limited distribution drug lists during procurement. ?? Monitor your spend and ensure no egregious markups on specialty generics are taking place. If they are - engage the PBM as a steward of the plan. ?? Reconcile your contracts EVERY YEAR to ensure the contract guarantees set forth are being met. https://lnkd.in/gcetr3XM
