Security Deposit Tips for Utah Landlords Security deposits help landlords cover any damage a tenant might leave behind. But to stay on the right side of Utah law and keep things running smoothly, landlords need to handle security deposits correctly. A common question is: How long do I have to check for damages, and what if I don’t have the full refund ready in time? This article will break it down in simple terms. What Is a Security Deposit? A security deposit is money collected at lease signing to cover damages beyond normal wear and tear. If tenants maintain the unit, they should get their deposit back. Some landlords also charge a lease initiation fee, which is non-refundable, making only part of the deposit refundable. How Long Do You Have to Return a Security Deposit? Utah law gives landlords 30 days after the tenant moves out to return the security deposit or provide a written list of deductions. If there are damages, unpaid rent, or other charges, landlords must explain them in detail and return any remaining balance to the tenant or let the tenant know how much they owe What If You Need More Time? If a landlord doesn’t return the deposit or provide an explanation within 30 days, the tenant can send a 5-day notice to provide a deposit disposition. This notice works similarly to a 3-day notice that landlords give tenants when they aren’t following the lease. If a landlord ignores this notice, they could face penalties, including fines and legal trouble. It’s always best to stay within the 30-day deadline, but being a day or two late isn’t the end of the world keep an open line of communication with the tenant and keep them in the loop. Problems mainly start if the landlord ignores the 5-day notice. How Much Should You Charge for a Security Deposit? Landlords can decide how much to charge for a security deposit, but it should be reasonable. Consider possible repair costs and how much risk comes with renting out the unit. And look at what your competitors are doing to get an idea of what your market considers a reasonable deposit. Types of Security Deposits ·???Refundable Security Deposit – The amount the tenant can get back if they return the rental in good condition, except for normal wear and tear. ·???Non-Refundable Fees – Some landlords charge extra fees, like lease initiation fees, that tenants won’t get back. These should always be clearly listed in the lease. Best Practices for Handling Security Deposits ·???Do a Move-In Inspection – Take pictures and write down the unit’s condition before the tenant moves in to avoid disputes later. ·???Keep Good Records – Save all receipts and invoices for any deductions from the deposit. ·???Communicate Clearly – Let tenants know what’s happening with their deposit, and if there are delays, keep them informed.
