?? ?? ?? SCOTUS has handed down a ruling (on purpose this time) on Idaho v. United States, the case that was supposed to decide the fate of the Emergency Medical Treatment and Active Labor Act (EMTALA). In a nutshell, the ruling reinstates a lower court’s decision to allow Idaho doctors to perform life-saving and stabilizing abortion care. However, this ruling essentially kicks the can down the road—the Court didn't decide anything on the merits of the case. Similar to the fight over mifepristone access, SCOTUS bought Republicans time to talk about abortion?after?the election. This morning the Supreme Court issued a unanimous decision in?FDA v Alliance for Hippocratic Medicine,?ruling that the plaintiffs who challenged the FDA's approval of mifepristone lacked legal standing to bring their claims.? While access to mifepristone, one of two drugs used in medication abortions, is safe for now, the case has been sent back to the lower courts in Texas, where more litigation is expected. Today we are relieved.
