关于我们
I’ve spent 20+ years specializing in the law affecting companies and programs in the outdoor recreation industry. My clients range from universities to Everest guides to equipment manufactures. I’ve defended raft companies, mountaineering guide services, canoe liveries, climbing, ropes courses and others in court. I’ve published in the Wilderness Medical Society Journal, Paddle Dealer, Inside/Outside, Scouter, GearTrends & Recreation Management. I was a contributor to the Risk Management Chapter of the BSA Field Book and have written chapters in Legal Liability and Risk Management in Adventure Tourism and Controversial Issues in Adventure Programming. I teach Ski Area Risk Management for Colorado Mountain College. I’ve taught seminars at Cornell, Oregon State University, University of Idaho, University of Utah and other colleges. I am the US representative to the Safety Committee of the Union Internationale des Association d’Alpinisme (UIAA) and a member American Society of Testing & Materials (ASTM). I currently serve on the board of directors of the Galapagos Conservation Association and the Denver Area Council, Boy Scouts of America. I have severed on the board of directors of the Trade Association of Paddlesports and the Colorado Alliance for Environmental Education. When I'm not practicing law or writing, I still work as a river guide for commercial whitewater rafting companies. I know this area of the law and enjoy working with my clients to protect them from the issues they may encounter.

The validity of the release in the case of the injured brother at the ski resort was upheld based on the testimony of the non-injured brother. The non-signing brother stated during his deposition that he had the authority to sign the release on behalf of his brother. This testimony was crucial in determining the validity of the release, and the courts accepted it as sufficient evidence to support the authorization of the signing brother. The courts found that the non-signing brother was firm in his statement about having the authority to sign for his brother, and therefore, the release was deemed valid. This case highlights the importance of clear and explicit authorization when signing releases on behalf of others, especially in situations involving potential risks or injuries. The courts relied on the testimony of the non-injured brother to uphold the release, emphasizing the significance of legally sound and informed authorization in such matters. https://lnkd.in/gyr5vBuS #Lawsuit #Injury @RecreationLaw #SkiLaw #SkiAreaLaw #RecLaw #RecreationLaw
