    DOJ Statement of Interest in Sitzer Proposed Settlement 1. The DOJ is not done investigating not only the provisions of the Proposed Settlement, but other alleged antitrust behavior in the residential real estate space as well. 2. The DOJ does not care for the buyer broker requirement the way it is described in the proposed settlement and as currently constructed in the proposed settlement, could bring other antitrust concerns. 3. The DOJ was not a party to the litigation or the settlement and compliance with the settlement does not eliminate potential antitrust liability. 4. Removing Offers of compensation is a good start, but the proposed settlement does nothing about offers of compensation off the MLS, and, the DOJ stated in its Nosalek Statement of Interest, it does not want offers of compensation anywhere, on or off the MLS. 5. The court, if it does finalize the Settlement, should be clear that compliance affords no immunity or defense for the buyer broker provision. 6. The responsibilities of the parties in the Civil Class Action litigation are not the same as the DOJ's antitrust responsibilities. 7. The DOJ will have a lot to say at the Settlement hearing, would be my final takeaway. https://lnkd.in/d7RZM--6

However, what they?can?do is provide?a strategic advantage through transparency, trust, and value-driven guidance. ?? For instance, let’s break it down with an example: Scenario: Low-Inventory Market (Role Model Comparison) ? Listing Price:?$1,000,000 ? Market Situation:?3 competing offers, requiring a budget of $1,100,000 to win the deal. 1?? NEGOTIATOR? Approach: ? NEGOTIATOR?:?“My compensation model is based on the Inverse Commission structure, where I get paid 50% of what I save you. To help you secure this home, I’ll ask for 2.5% to be refunded into a GAP fund and put it in the offer. Part of this fund goes toward my compensation, and the rest directly benefits you. My goal is to negotiate the deal at $1,050,000 instead of $1,100,000 and find flaws in the house to your advantage. If I succeed, you save extra $$, and I get paid more for delivering better results.” If I can’t, I’ll get paid less than traditional fixed 2.5% agent.?That’s my financial motivation. 2?? Traditional Agent Approach: ? Traditional Agent:?“I earn 2.5% of the total sale price, as added in the offer. It doesn’t matter to me whether the final price is $1,050,000 or $1,100,000—my compensation remains the same. Ethically, I’ll try to secure the property for $1,050,000,?but my income isn’t tied to this effort. That’s my moral obligation, rather than absent financial incentive, drives me to do my best for you.” ?? This comparison highlights a critical point, while both scenarios for buyers has almost the same $ cost:?why buyers should consider being represented by a NEGOTIATOR? instead of a traditional agent or falling into the pitfalls of dual agency.?The NEGOTIATOR? approach not only prioritizes the buyer’s best interests but also builds trust by aligning financial incentives with results. ?? Even in challenging markets and low-inventory environment, this approach gives buyers a?compelling reason to choose proper representation?and ensures they feel confident about the process.     Now that the MLS has eliminated the offer of compensation (the "MLS Crutch"), the buyer's broker must earn the buyer's trust to sign an exclusive buyer representation agreement and then perform well to negotiate the best terms and savings for the buyer at the closing table. NEGOTIATOR(r) compensation is calculated on the savings for the buyer in the transaction -- it is based on the level of performance, something unique in real estate brokerage.

    The 2nd Annual International MLS Forum was a great success. It was inspiring to see people from around the world, including Mongolia, gather to discuss the value of MLS and how to begin the process of creating an MLS in the countries outside of North America that do not have MLS, but want MLS. This group of about 200 "pioneers" gets it...and MLS discussions with no mention of compensation...the value of MLS being cooperation, the platform, and the data...the "single source of truth" and what that can bring to the world. And it is now official, the event will be held in Toronto in 2025 and Dubai in 2026. Congratulations to Real Estate Standards Organization (RESO) , CEPI, Stellar MLS , and Realtyna , the driving forces behind this event that is destined to become a true, worldwide "MLS Movement."
