That’s the central question at the heart of Andrew Forrest v. Meta, a case spanning both Australia and the United States—and one that could reshape platform liability worldwide. Between March 2019 and November 2023, over 1,000 scam Facebook ads misused Forrest’s likeness without consent, promoting fraudulent cryptocurrency schemes. Jason Frankovitz has been engaged as a software expert in both cases, analyzing Meta’s ad algorithms, content moderation, and responsibility in fraudulent ad placement. His findings could help determine whether Meta’s systems merely host content—or actively contribute to deception.
