On April 3rd, I had the opportunity to present my research on Florida’s Direct File policy at FSU’s Annual Undergraduate Research Symposium. During my Honors Directed Individual Study experience with professor & mentor, Dr. Radha Modi, I assess the constitutionality of Direct File in Florida, focusing on the 5th, 8th, & 14th amendments of the U.S. Constitution. Florida transfers children to the adult criminal justice system via Direct File at a rate that is five times higher than the national average. While having the highest transfer rate in the nation, there are also significant racial & geographic disparities regarding which children are subject to adult criminal processing. Using Supreme Court precedents, developmental neuroscience, & a comparison of other state’s transfer laws, I suggest amendments to Direct File to avoid arbitrary application & to protect the rights of our state’s youth.
