The Ohio Supreme Court recently laid to rest the age old argument of how to apply the "same juror rule" to malpractice actions. In Ohio, the agreement of three-fourths of a?jury's?members is required to reach a?verdict. Now, in?negligence?cases where jurors vote step-by-step to reach a decision, only the jurors who find a person acted negligently can vote to determine if that person is at fault for causing the plaintiff’s injuries. DEFENSE DECISION FOR THE EMPLOYER! After nearly two years of investigations and litigation, as well as a $200,000 settlement demand, John B. Bauer received a defense decision at the Industrial Commission in favor of a roofing client. A Staff Hearing Officer found it would be inappropriate to give a Violation of a Specific Safety Requirement (VSSR) award to the claimant when the employer did not know of the specific hazard, a concealed hole/opening in the structural metal decking of the building’s roof.
