The Ohio Damage Caps in medical malpractice cases have been ruled unconstitutional by the 8th District Court of Appeals in Cleveland. The court found that the cap on noneconomic damages was deemed arbitrary and unreasonable, violating rights under the due course of law clause in the Ohio Constitution. These caps have historically served as a safeguard against runaway juries in Ohio. However, they have encountered ongoing opposition from the Plaintiff's bar over the last several years. An appeal to the Ohio Supreme Court is anticipated following this decision. #OhioLaw #LegalUpdate #CourtDecision

AI is revolutionizing healthcare by simplifying everything from paperwork to diagnostics, but doctors are still on the fence, worried about patient privacy, the doctor-patient relationship, and the looming threat of malpractice lawsuits. https://lnkd.in/gU4gTqiH

The Ohio Supreme Court recently laid to rest the age old argument of how to apply the "same juror rule" to malpractice actions. In Ohio, the agreement of three-fourths of a?jury's?members is required to reach a?verdict. Now, in?negligence?cases where jurors vote step-by-step to reach a decision, only the jurors who find a person acted negligently can vote to determine if that person is at fault for causing the plaintiff’s injuries. A common sense decision of great value to Ohio litigators! Read more below: https://lnkd.in/gBK-3VD5

Are you using AI in your legal practice? What implications might this have for you and your clients? #teampoling prioritizes efficiency and effectiveness, but AI may not be the way to go. Things to consider when discussing use of AI might include accuracy of the AI system, confidentiality of client information, who you may need to disclose your use of AI to, and appropriate fees for use of AI.
