Here’s what you need to know: The biggest change to remember is that the IRS now requires e-filing for all returns with more than 10 information statements. Note that the 2024 affordability percentage of 8.39% has been increased to 9.02% for 2025. The IRS has increased its audit activities. The transition to Applicable Large Employer (ALE) status marks a significant shift in your organization's ACA compliance obligations. But what exactly triggers this change? Your business becomes an ALE if you averaged 50+ full-time equivalent (FTE) employees during the previous calendar year. “Full-time equivalent” can mean: Full-time employees working 30+ hours per week or 130+ hours per month Part-time employees when their hours are combined count toward FTE calculation (total monthly hours ÷ 120) Seasonal workers can count in certain calculations Employees under common ownership may need to be counted together ALE status matters because it triggers ACA responsibilities, including annual reporting to the IRS, offering affordable health coverage that meets minimum standards, and other compliance requirements.
