Nohavicka, recently completed a 10-day Federal Court trial at the United States District Court in Newark, NJ, representing PN client Jiaherb, Inc. in a high-stakes commercial litigation case. Case Breakdown: 1. Parties Involved: Jiaherb, Inc., a manufacturer of herbal extracts, and MTC Industries, Inc., a supplier of nutritional ingredients. 2. Product in Question: Saw palmetto extract, commonly used in health supplements. 3. Allegations: PN Client Jiaherb accused MTC of adulterating (cutting) its saw palmetto extract with vegetable oils, like coconut oil, without disclosure. 4. Misrepresentation Claims: MTC allegedly marketed its product as pure and exceeding U.S. Pharmacopeia standards. 5. Detection Challenges: Adulteration was extremely difficult to detect. 6. Discovery of Adulteration: A customer’s advanced Nuclear Magnetic Resonance testing uncovered the presence of coconut oil. 7. Consequences: The discovery led to many large scale canceled purchase orders 8. Further Verification: Jiaherb conducted independent testing, which confirmed the adulteration. 9. Financial Impact: Jiaherb sought a full refund and damages for the adulterated product. 10. Legal Action: Our firm filed a lawsuit alleging product adulteration, false advertising and unfair competition under the Lanham Act.   • The new rules are part of the city's larger efforts to enforce against 'ghost cars,' vehicles with fake, obscured, or altered plates used to evade law enforcement, tolls, speed cameras, and parking rules. Since 2022, over 73,000 ghost cars and unregistered motorized vehicles have been removed from city streets. The newly adopted rules take effect on April 16 and clarify that any obstruction to a license plate is strictly prohibited. The key rule changes include: License Plate Visibility: Plates must be properly displayed and kept clean and unobstructed. No glass or plastic covers are allowed. Prohibition of Altered or Fake Plates: Any material that conceals or mimics a legitimate plate is strictly prohibited. Ban on Vehicle Covers: No vehicle may be parked with a cover that conceals its license plates, registration stickers, VIN, or other identifying information. Distorted Plates: Plates may not be altered in any way that obscures readability. Any material that distorts or reflects light in a way that prevents cameras from capturing plate numbers in photographs or video recordings is strictly prohibited. Parking with an obscured plate will result in a $50 fine.
