Congratulations to Albert Peacock and Juliette McCullough on their win in "Ali v. Pasha Hawaii Holdings," (NDCA Case 20-cv-08122). Assisted by Denise Brasher, they prevailed in obtaining a defense verdict for a ship operator against multiple claims from a Jones Act seaman. The Court appropriately agreed that there was no evidence of negligence, no unseaworthiness, and no entitlement by the seaman to further "maintenance & cure."?This was a complete victory - hard fought and well deserved. Congratulations! PS:?This is Peacock Piper Tong + Voss LLP's third consecutive trial win in fully-litigated Jones Act cases over the last year.?The first case, led by Al and Samantha Mahoney, resulted in a full defense verdict.?The second jury case, tried by Al and Juliette, resulted in a finding of 95% contributory negligence by the seaman.?And now this judgment for the defendant.??It’s an impressive record in any litigation, but perhaps especially in Jones Act cases since seaman plaintiffs are the favored wards of the admiralty.?Way to go team!?
