Last Friday I had the privilege of speaking on the topic of AI in Immigration Law at the #AILA Conference in Monterey, CA. Big thanks to my co-panelists Jeffrey O'Brien, JD, Charity Anastasio, and Brittany Thomas Faith. We discussed how AI can and will reshape the practice of immigration law, and considerations for how to enable this in an ethical manner to deliver more efficient, effective, and accessible legal services. 1?? AI as a Trusted Legal Assistant (with Supervision): Immigration lawyers need to start thinking of AI as an assistant with extraordinary abilities—able to generate efficient drafts, extract key facts, and conduct supervised research in record time. But, like any assistant it also shouldn’t be relied on as a perfect solution and requires very defined and structured oversight and refinement from experienced legal professionals. This marriage should be developed through defined workflows and processes ensuring the advantages of these tools are leveraged without sacrificing quality. With careful supervision and purpose-built workflows, AI can significantly enhance speed, accuracy, and overall customer satisfaction. 2?? Embracing the Power of AI and Client Demands AI isn’t a tool that we can afford to ignore, it's too powerful. Energy should be put into figuring out how to ethically leverage the best tools and not whether to leverage them. This isn’t just a nice-to-have like a scheduling app; it’s a fundamental shift in how legal work can and should be done. It is also very telling when the government, including the USCIS, in many adjudication and screening use cases, are heavily leveraging AI (more on this in a future post). If we look outside of immigration law, clients themselves are also starting to leverage these tools to demand more out of their legal counsel. This was discussed by the highly respected Damien Riehl as well, as corporations themselves are leveraging tools like vLex to obtain initial draft guidance to then pass along to their outside counsel to improve. 3?? New Business Models & Client-Centric Solutions: As AI changes the way we work and as it drives what clients expect, there are incredible opportunities for those truly focused on what their clients want. With the acceleration of immigration-focused AI tools being developed, understanding not only the importance of data security and privacy but also the nuances of immigration, the future is bright for those along for the ride. These tools, such as Parley (YC S24), are built to enable lawyers to do their best work by allowing them to focus their time on legal strategy, analysis, and refining work product, instead of burning hours on non-legal tasks.
