Will the Trump Gold Card replace EB-5? I'm sure you've heard about President Trump's announcement of the $5 million Gold Card, claiming it will offer green card privileges and a path to citizenship for wealthy people. He mentioned it will be rolled out in two weeks. So my guess is it will be done through an executive order, much like DACA and TPS. During the announcement, the Secretary of Commerce stated that the EB-5 program would be replaced with the Gold Card. However, here’s the reality: the President cannot unilaterally end EB-5—it would require an act of Congress. The current EB-5 law is valid until September 2027, and grandfathering provisions remain valid through September 2026. This means that if you file your EB-5 I-526E petition before the end of September 2026, your case will be processed, even if the program ends in 2027. So for now, nothing has changed. But since Congress could choose not to renew EB-5 after 2027, it might be a good time to apply. What is a USCIS ASC, and how is it different from a USCIS Field Office? A USCIS Application Support Center (ASC) is a local office where biometrics are collected. If you have an ASC appointment, it is to only take your fingerprints, photograph, and signature in order to verify your identity and run background checks. Here's a quick update on President Trump's executive order limiting birthright citizenship. Today, a federal judge issued a temporary restraining order (TRO), pausing the implementation of the executive order for 2 weeks. Last night, President Trump issued an executive order limiting birthright citizenship. And here is what it means for business immigration, particularly families in the U.S. on work visas. Under the 14th Amendment, all children born in the United States are automatically U.S. citizens, regardless of their parents’ immigration status. But now, children born in the U.S. to parents on valid work, business, or investor visas, or to undocumented parents, will no longer receive U.S. citizenship—unless one parent is a U.S. citizen or green card holder. Here is what you need to know: (1) The order applies to children born on or after February 20, and it is not retroactive. (2) It affects families on all types of temporary visas, including H-1B, L-1, E, O-1, P, TN, F-1 students, B-1/B-2 visitors, and those in the U.S. under the Visa Waiver Program. (3)?The government will withhold passports for these children, leaving their status uncertain. A lawsuit has already been filed, and a temporary injunction could be granted, but a final resolution may take years.
